“Values are the driving force of every normalisation; the norm is value solidified into obligation.” This work analyses the relation between values and norms in a width and depth not previously seen. Fundamental issues of legal theory and legal philosophy are answered using a general theory on values and moral concepts, value thinking and value language, and combined into a closed edifice of ideas. The author consistently positions himself as a subjectivist and relativist by first rejecting absolute and objective value theories as unprovable and subsequently postulates a provability of legal and moral norms that is exclusively relative. The result is a moderately legal positive approach which does not regard justice as a necessary conceptual component of law, but which views it as a target value of legislation and legal practice. „Werte sind die Triebfeder jeder Normierung, die Norm der zu Verbindlichkeit geronnene Wert.“ – Die Schrift analysiert das Verhältnis von Werten und Normen in einer bisher so nicht gekannten Breite und Tiefe. Dabei werden grundlegende Fragestellungen der Rechtstheorie und Rechtsphilosophie mittels einer allgemeinen Theorie über Werte und Wertvorstellungen, Wertdenken und Wertsprache beantwortet und zu einem geschlossenen Gedankengebäude zusammengefügt. Der Verfasser positioniert sich dabei konsequent als Subjektivist und Relativist, indem er zunächst absolute und objektive Werttheorien als unbeweisbar zurückweist und dann hierauf aufbauend eine nur relative Begründbarkeit von Rechts- und Moralnormen postuliert. Das Ergebnis ist ein gemäßigt rechtspositivistischer Ansatz, der in der Gerechtigkeit zwar keine notwendige begriffliche Komponente des Rechts sieht, diese aber zur Zielgröße von Rechtsetzung und Rechtsanwendung erklärt.
